End-User License Agreement (EULA)
Last updated: 3 October 2026
This is an English translation of our German End-User License Agreement. In case of doubt, the German version applies.
The Miracal app (“App”) is licensed – not sold – to you by Warin Winnicke, Alsterdorfer Str. 165, 22297 Hamburg, Germany, VAT ID DE356662333 (“Licensor”), for use only under this agreement. Our terms and conditions and privacy policy also apply.
By downloading or using the App from Apple's App Store or Google Play (together, the “Stores”), including updates, you agree to this agreement. The Stores are not parties to this agreement and have no obligations regarding the App, such as warranty, maintenance or support. The Licensor alone is responsible for the App and its content. This agreement may not conflict with the Stores' usage rules; where it does, those rules prevail.
1. Scope of licence
The Licensor grants you a non-exclusive, non-transferable, non-sublicensable right to install and use the App on devices you own or control, as permitted by the Stores' usage rules (including Family Sharing). The licence also covers updates unless they come with a separate licence.
You may not rent, lend, sell or otherwise make the App available to third parties except as the Store rules allow. You may not modify the App, decompile, disassemble or attempt to derive its source code, except where mandatory law permits it. You may not remove copyright or proprietary notices. All rights not expressly granted remain with the Licensor.
2. Technical requirements
The App requires an iPhone with iOS 15 or later or an Android device with Android 9 or later; the information in the Store is authoritative. Features such as weather and purchases need an internet connection. The Licensor endeavours to keep the App compatible with new operating system versions.
3. Maintenance and support
The Licensor alone is responsible for maintenance and support of the App. Apple and Google have no obligation to provide any maintenance or support. You can reach support via the contact page or by email at info@miracal.app.
4. Use of data
The Licensor processes data only in accordance with the privacy policy and your settings in the App. The App has no user account; events, contacts and tasks stay on your device and in your existing accounts.
5. Warranty
Statutory warranty rights apply. The Licensor warrants that, at the time of download, the App is free of malware and substantially performs as described. There is no warranty for defects caused by unauthorised modifications, improper use or unsuitable hardware or software. Please report defects via the contact page.
If the App fails to conform to any applicable warranty, you may notify the Store, which may refund the purchase price under its rules. To the maximum extent permitted by law, the Stores have no other warranty obligation with respect to the App.
6. Liability
The Licensor's liability is governed by section 11 of the terms and conditions: unlimited for intent, gross negligence, injury to life, body or health and under the German Product Liability Act; for slight negligence only for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract.
7. Product claims
As between you, the Licensor and the Stores, the Licensor – not Apple or Google – is responsible for addressing any claims relating to the App or your possession and use of it, including (i) product liability claims, (ii) claims that the App fails to conform to any legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy or similar legislation.
8. Third-party rights
If a third party claims that the App or your possession and use of it infringes their intellectual property rights, the Licensor – not Apple or Google – is solely responsible for the investigation, defence, settlement and discharge of that claim.
9. Export and sanctions
You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
10. Third-party terms
When using the App you must comply with applicable third-party terms, such as those of your mobile or internet provider and of the calendar services you connect.
11. Third-party beneficiaries
Apple and Google and their subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance of this agreement, they have the right (and are deemed to have accepted the right) to enforce it against you as third-party beneficiaries.
12. Term and termination
This agreement is effective until terminated by you or the Licensor. You can end it at any time by deleting the App. If you materially breach this agreement, your right of use ends and you must delete the App. Paid subscriptions are cancelled separately in the Store.
13. Governing law
The law of the Federal Republic of Germany applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected.
14. Final provisions
If any provision is invalid, the validity of the remaining provisions is unaffected; the statutory provisions take its place.
